Joshua James Quigley, 30, 689 Coal Hill Road, Clearfield, is also charged with five summaries. He waived his right to a preliminary hearing that was scheduled for today. The charges against him will be sent to the Court of Common Pleas for further disposition. His bail was set at $10,000, unsecured.
According to the affidavit of probable cause, at 2:40 a.m Oct. 31, an officer on patrol saw a vehicle cross the double-yellow line in the area of Berndt's Tobacco Outlet in Curwensville Borough.
The driver was identified as Quigley. As the officer spoke with him, he noticed an odor of an alcoholic beverage. He said Quigley's eyes were glassy and his speech was slurred. Quigley was asked if he had been drinking and he said he had.
When he failed to perform the standard field sobriety tests, Quigley was taken to the Clearfield Hospital for a blood test. The result showed a blood alcohol content of 0.222 percent. The legal limit in Pennsylvania is 0.08 percent.
This is the second time this year that Quigley has been in court. He pleaded guilty in August to a summary charge of disorderly conduct.
According to court documents, he spoke over a loudspeaker and played a siren around 3 a.m. Aug. 24, annoying numerous residents on Montgomery Run Road in Lawrence Township.
He paid fines and costs totaling $223.50.
Quigley has been the Emergency Management director since 2007. The commissioners had no comment on the matter Tuesday.
